Terms of Use

1. Where our Terms of Use apply
With the creation of a user account at GamersGlobal, by posting a comment or by logging in, the following Terms of Use apply. GamersGlobal reserves the right to change the Terms of Use / AGB at any time without prior notice and without giving reason for the changes. However, should, in the opinion and at the sole discretion of GamersGlobal, a change or addition be in considerable conflict to an existing rule, the users will be notified two weeks in advance via a message on the homepage of GamersGlobal and/or by email. If a user rejects such a change identified in the notification, GamersGlobal may cancel the user's account and delete all data stored in it, without liability and without compensation to the user. If a user does not want to or cannot give consent to all of the rules of these Terms of Use, the user must not use GamersGlobal.

2. Creating and using an User Account
Creating an account at GamersGlobal is free. You may only create an account at GamersGlobal when you are 18 years of age or older. Children ages 14 to 17 require the consent of their parents. Children below the age of 14 may not create a user account at GamersGlobal. GamersGlobal may ask every user for validation of his age. Every person may only have one account at GamersGlobal. All user information entered must be truthful. By creating an account, the user acknowledges that all user submitted material, unless quoted otherwise, falls under the Creative Commons License. In accordance with or in addition to that license, the user guarantees to GamersGlobal that the material he submits (e.g. photos, text, videos) are either created by himself or are legal for him to submit on a news website (for example, screenshots provided by a publisher must be intended for use by online press and must not be exclusive to one website or a group of websites). Among other provisions, the Creative Commons license allows GamersGlobal to translate users’ contributions into other languages, shorten them or enhance them at the sole discretion of GamersGlobal. With the creation of an account, the user also agrees to follow GamersGlobal's guidelines on How to write News, which require that news is lawful, truthful and fair without being insulting. Please note that content that is created by the staff of GamersGlobal (e.g. Interviews) does not fall under the aforementioned Creative Commons License.

3. Cancelling an User Account
If a user cancels an account, all account information will be deleted (but not necessarily the articles, news or comments supplied by the user), and the relationship between GamersGlobal and the user ends. To cancel your account, send an e-mail to

with the subject “Cancel >your username<” and leave the mail body blank.

4. Description of the services of GamersGlobal
GamersGlobal is a website for computer and video game-related content, based in Germany, but written for an international audience. It not only provides news and longer articles (specials), but allows registered users to participate. Participation can include user written news, user updates to news, comments, other forms of user written content and articles (e.g. Interviews or Reviews or FAQs) or user collaboration on articles. To increase the quality of the news published on GamersGlobal, not every registered user will have initial access to all forms of participation in content creation. Instead, by participating with the tools provided by the user’s current "user role," that user may be granted access to additional tools. Some tools may be granted automatically (e.g. linked to the number of news items and comments written by the user), while others may involve an act of will by a representative of GamersGlobal. Also, some users may be granted the right to change the user priveleges of other users. GamersGlobal may allow users to vote on news provided by GamersGlobal or other users. These votes may have automatic consequences (e.g. promoting a news item from the "New" to the "Top" section) or may only serve as feedback for the GamersGlobal staff to take into consideration when manually promoting a news item. By combining our own editorial efforts with those of our users, we strive to make GamersGlobal a leading game news community that specializes in fast, accurate and neutral news.

5. Cost of Service, revenues for GamersGlobal
GamersGlobal is financed by advertisements and is free for the users. However, GamersGlobal may decide to add additional services at a later time and may decide to charge its users for those features, at the sole discretion of GamersGlobal. Also, GamersGlobal may include online shopping or links to shops that are not free of charge to use, and may profit from the revenues generated by its users in those shops. GamersGlobal may also compile user-posted content in various forms or syndicate its contents commercially. GamersGlobal may commercially syndicate anonymous poll results (e.g. "What game do you want to buy for Christmas?"), but never in a form where individual users can be linked to particular polls or part of polls (see 6).

6. Privacy
GamersGlobal strongly believes in the privacy of its users. GamersGlobal follows all German and European-Union-wide privacy laws, including TDDSG, BDSG and TKG (§§ 85 ff). In particular, GamersGlobal will never sell addresses or other personally identifiable user information to third parties or make its user data available to third parties in any form, unless required to do so by law (e.g. in an investigation against one of its users) or unless the user gives his explicit consent to do so (for example, when participating in a contest where prizes can be won). For administrative and editorial purpose only, activity of all registered users is logged for four weeks. All log files are automatically deleted after four weeks. GamersGlobal may use statistical data derived from its user information, e.g. concerning the demographics of GamersGlobal users, but only in a way such that users' data cannot be linked to an individual. If a user has given his consent for his personal data to be shared with third parties, he may revoke that permission at any time.

7. Cookies and Javascript
GamersGlobal will place the following cookies: The “PHPSESSID” cookie helps to identify each visitor for the duration of his visit at GamersGlobal. Additional information is available from this source. The “css_layout” cookie will remember your choice of website design. These Cookies are in no way used to profile users and may both be declined.
Reading GamersGlobal does not require you to use Javascript, but as an active user we recommend you enable Javascript for increased ease of use and accessibility.

8. Limited Liability of GamersGlobal
GamersGlobal cannot be held responsible for the news, comments, edits or articles supplied by its users. GamersGlobal is only responsible for the content created by its own editorial team. Because GamersGlobal users guarantee that they only use material in their contributions that is their own or that they have the right to use, GamersGlobal cannot be held responsible for possible copyright infringements or the personal rights of third parties. In particular, GamersGlobal cannot be held responsible for the damage companies may suffer or may perceive they have suffered due to perceived criticisms expressed in our content towards their products or business decisions. GamersGlobal cannot be held responsible for the damage which individuals may suffer or may perceive they have suffered through the malicious use of information provided at GamersGlobal by other users or by third parties. Nevertheless, GamersGlobal tries to check all content published for errors or insults to uphold the high quality of its content.

All statements in this article also apply to links from GamersGlobal to content on other websites; all content on other websites is the responsibility of the publishers of those other websites -- although GamersGlobal will check all links posted by its own editorial team (not links published by users) at the time the link is published. A checked link is one for which the direct target page of the link has been checked, not other links or pages on that website.
GamersGlobal cannot be held responsible for erroneous information supplied by the users, e.g. in the user information of their account. GamersGlobal asks its users and third parties to immediately inform GamersGlobal of any errors, insults, violations against GamersGlobal's terms of use, copyright infringements and similar problems on its website and also on linked websites to enable GamersGlobal to solve the problem (e.g. correct the error, delete the copyrighted material, delete the link linking to a website which illegally uses copyrighted material, et cetera). GamersGlobal tries to offer its website and services "24/7", but does not guarantee to do so -- maintenance work by GamersGlobal, maintenance work by its hosting provider, technical problems or other reasons may limit the availability of GamersGlobal's website and services. GamersGlobal reserves the right to cancel some or all of its services or the website itself at any time. GamersGlobal reserves the right to delete some or all of its content (news, articles, photos, videos etc.) and to delete some or all of its user accounts and other user supplied data, without compensation to the users or third parties.

GamersGlobal shall not be liable to you or any third parties for any direct, indirect, consequential or punitive damages allegedly sustained arising from these terms of use, from providing the website, from the sale or purchase of any goods, from the user's access to the website (including viruses alleged to have been obtained from the website), from the user's use of or reliance on the website or any of the information or materials available on the website, regardless of the type of claim or the nature of the cause of action, even if advised of the possibility of such damages. The user agrees to release GamersGlobal, its affiliates and third-party service providers, and each of their respective directors, officers, employees and agents from any claims, demands and damages (actual and consequential) of every kind, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with the user's use of GamersGlobal or in violation of these Terms of Use.

9. Liability of the user
Users of GamersGlobal are responsible for all information provided to GamersGlobal, for all content they submit and for all changes they may apply to the content provided by other users or by GamersGlobal. See the rules in How to write News. In particular, the user guarantees to GamersGlobal that the content he or she provides is true (to the user's best knowledge) and is either free from the rights of third parties or is explicitly meant to be used on a news website by the copyright owners (e.g. press screenshots of upcoming games that are not exclusive to another website or a print magazine). Also, users are not allowed to publish fascist, racist, or pornographic content or content that is in other ways unlawful or that is insulting to other users. Also, users may not publish content that has a political agenda (unless directly linked to the Gaming industry or Gaming scene) or that has the purpose of advertising a product, brand or company. Also, users must not illegally exchange copyrighted materials or "serials" through GamersGlobal. Users may not use some or all of the content on GamersGlobal commercially, also users may not collect or compile information on or about other users (e.g. from other users accounts or personality pages on GamersGlobal). As GamersGlobal is located in Germany and has to follow German law, its users must not post or create content that includes symbols of the "Third Reich" (Nazi Germany), e.g. the Swastika. Also, users must not post or create content that denies or belittles the crimes of Nazi Germany. Because of German youth protection laws, some screenshots showing exceptionally strong violence in a computer or video game might not be able to be shown on GamersGlobal. This does not hinder GamersGlobal or prevent its users from writin about such a game (as long as the news does not glorify the exceptionally strong violence). In addition to following these terms, users of GamersGlobal must not post links to sites with such or other unlawful content.

10. Use of third parties
GamersGlobal may use third parties to provide some or all of the services of the GamersGlobal website.

11. Violations of these Terms of Use / AGB
If a user violates the Terms of Use or any part of it, GamersGlobal may immediately and without prior notice cancel the account of the user and delete all data stored in it, without any liability to the user and without any compensation for the user. If legal issues relate to the cancelling of an Account (e.g. if a user violates the law), GamersGlobal reserves the right to commence legal action against that user. In particular, any attempt to hack, manipulate or in other way attack GamersGlobal's servers, databases or content sites by electronic means will be prosecuted.

12. Severability Clause
If one or more articles or terms in these Terms of Usage should be incomplete or unlawful, or should they become so in the future, all other terms and articles will remain valid. The invalid term or article is to be exchanged for a lawful one which commercially resembles the original meaning and purpose as closely as possible. The same applies for terms or articles that may have been omitted from these Terms of Use.

13. Court of Jurisdiction and applicable Law
Insofar it is legally permissible, the court of jurisdiction is Munich, Germany. GamersGlobal is subject to the laws of the Federal Republic of Germany.
